Statute of Limitations for Suspended Sentences - Standardization of Jurisprudence

On June 30, the Supreme Court of Justice established case law on the interpretation of the limitation period applicable to suspended prison sentences during their execution, namely after the suspension period has elapsed without its revocation or extension.

This ruling establishes an objective and uniform criterion: once the suspension period has elapsed, four years run until the sentence is time-barred, unless there are causes for suspension or interruption of the period, in strict application of the letter of the provisions of Article 122(1)(d) of the Penal Code.
