Constitutional Court considers time limit for investigating paternity unconstitutional

In ruling no. 523/2025 of the Constitutional Court on 17 June, seven judges against six voted for the unconstitutionality of the rule in the Civil Code law that provides for a maximum time limit of 10 years, after the age of majority, for someone to bring a paternity investigation action.

After balancing the fundamental rights in conflict, the Constitutional Court decided to uphold the unconstitutionality of the time limit for bringing a paternity investigation action.
